A legal notice is the most cost-effective legal instrument in Pakistan. Drafted well, served properly, and answered by a demand for specific action within a set deadline, it resolves a majority of civil disputes before they see a courtroom.
1. When to send a legal notice
Recovery of dues (unpaid invoices, rent, dowry articles, salary), breach of contract, employment disputes, defamation, cheque dishonour under section 489-F PPC, encroachment, family-law demands, consumer complaints, and pre-suit demands generally. Some statutes (e.g. section 80 CPC for suits against the government) require notice as a jurisdictional pre-condition.
2. Structure of a legal notice
Heading and date; sender (advocate's letterhead) and addressee; reference to instructions; recital of facts in numbered paragraphs; identification of the legal wrong; specific demand and the deadline for compliance; consequence of non-compliance (suit for recovery, criminal complaint, defamation action); reservation of rights; signature and enrolment number of the advocate; instructing party's details.
3. Service
By registered post with acknowledgment of receipt, by courier with proof of delivery, and — where the opposite party's address is not certain — by email as a secondary channel. Proof of dispatch and delivery is retained; refusal or return unclaimed does not defeat the notice.
4. Response — from the notice-receiver's side
If you receive a legal notice, do not ignore it. Even where the claim is weak, a considered reply — through counsel — preserves your position, may narrow the dispute, and prevents adverse inferences at trial. Silence is often construed as admission of the factual assertions.
5. Timeline and cost
Drafting and dispatch: 48–72 hours in a straightforward matter. Response deadline: usually 7–15 days from receipt. Cost: fixed fee, generally PKR 15,000–50,000 depending on complexity, with any consequent litigation quoted separately.
6. When the notice is ignored
The notice becomes an exhibit in the subsequent suit. It demonstrates good faith on the sender's side, evidences the demand and the deadline, and is often the difference between costs being awarded and costs being denied.
7. Practical points
Do not send a notice threatening what you cannot pursue. Do not overstate facts. Do not send generic template notices — the specifics of your claim are what give the notice force. And do not, ever, send a notice yourself when there is any risk of misstating a fact that will be exhibited against you later.
